1. Company Information
This website and all associated reports and data products ("Products") are published and sold by Transparency Project LLC ("Company," "we," "us," or "our"). By purchasing or using any of our Products, you ("Buyer," "you," or "your") agree to be bound by these terms.
2. Terms of Use
By accessing this website or purchasing any Product, you acknowledge that you have read, understood, and agree to be bound by these Legal Disclosures and Terms of Use. If you do not agree to these terms, do not use this website or purchase any Product.
These terms constitute a legally binding agreement between you and Transparency Project LLC. Your purchase and/or continued use of our Products constitutes acceptance of these terms in their entirety.
3. Data Source & Federal Authority
All reimbursement rate data contained in our Products is extracted from Machine-Readable Files (MRFs) that health insurance issuers are required to publish under the federal Transparency in Coverage Final Rule (85 FR 72158), codified at 45 CFR 147.211.
This rule, effective July 1, 2022, requires group health plans and health insurance issuers to publicly disclose negotiated rates for covered items and services through machine-readable files updated monthly.
Our data was accessed from publicly available MRFs in January 2026. We do not obtain data through any non-public, proprietary, confidential, or unauthorized means. All source data is publicly available on the open internet as mandated by federal law.
4. Data Methodology & Limitations
4.1 Extraction Process
Rate data is programmatically extracted from insurer-published JSON and GZIP files. These files are often hundreds of gigabytes in size and contain millions of records. Our extraction pipeline filters for specific CPT codes, geographic regions, and provider types relevant to each report.
4.2 Deduplication
Where multiple rate entries exist for the same provider and billing code, we retain the highest observed negotiated rate for that provider. This approach was chosen to represent the most favorable rate available to each provider within that payer's network.
4.3 Outlier Handling
Statistical outliers (rates that fall outside reasonable bounds for the given CPT code) are identified and excluded. The specific methodology and thresholds used for outlier filtering are disclosed in each report.
4.4 Known Limitations
- MRF data may contain errors introduced by the insurance companies themselves during file generation.
- Some insurers update their MRFs more frequently than others; the data reflects what was published at the time of our access.
- Negotiated rates shown may not reflect supplemental payments, withholds, bonuses, value-based adjustments, risk-sharing arrangements, or other contractual terms.
- Rates in MRFs represent the plan-level negotiated amount and may not reflect what a provider actually receives after adjustments.
- Provider-to-rate linkages depend on the accuracy of NPI and TIN data as published in the MRFs and in the CMS NPPES registry.
- Some rates may represent group/facility rates rather than individual practitioner rates where the MRF data does not distinguish between the two.
- Our reports cover a single CPT code (90837) and should not be used to draw conclusions about rates for other procedure codes.
- This data represents a snapshot in time. Rates may have changed since the date of access.

6. No Affiliation with Insurance Companies
Transparency Project LLC is not affiliated with, endorsed by, sponsored by, or in any way connected to any insurance company, health plan, or healthcare organization whose data appears in our reports. This includes but is not limited to: Aetna, Anthem Blue Cross Blue Shield, Cigna, UnitedHealthcare, Florida Blue, Harvard Pilgrim Health Care, and Tufts Health Plan.
Use of these company names is solely for the purpose of identifying the source of publicly mandated data and does not imply any relationship, endorsement, or sponsorship.
All trademarks, service marks, and company names are the property of their respective owners.
7. Provider Data & Public Records
Our reports contain the names, credentials, cities, and National Provider Identifiers (NPIs) of individual healthcare providers. This information is derived from two public sources:
- Insurer Machine-Readable Files — Published by insurers under federal mandate (45 CFR 147.211). These files include provider identification information linked to negotiated rates.
- CMS NPPES NPI Registry — The National Plan and Provider Enumeration System, maintained by the Centers for Medicare & Medicaid Services, is a publicly searchable database of all healthcare providers with an NPI. This data is explicitly designated as public information by CMS.
We do not publish any protected health information (PHI), patient data, or information subject to HIPAA privacy protections. Negotiated rates between providers and insurance companies are not PHI.
Provider opt-out: If you are a healthcare provider and wish to request removal of your information from future editions of our reports, contact us at the email address listed below. Note that we cannot remove data from reports already sold, and your information remains publicly available in the federal data sources listed above regardless of any action we take.
8. Accuracy & Warranty Disclaimer
ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We make no representations or warranties regarding:
- The accuracy, completeness, reliability, or currentness of any data
- The suitability of the data for any particular purpose
- The results that may be obtained from using the data
- The accuracy of any earnings projections, calculations, or estimates
- Whether any particular rate shown represents a rate available to you or any other individual provider
We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we make reasonable efforts to ensure data quality, errors may exist in the source data, our extraction process, or our analysis. You use this data entirely at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRANSPARENCY PROJECT LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use of or inability to use our Products
- Any errors, inaccuracies, or omissions in our data or reports
- Any decisions made or actions taken based on information in our Products
- Any unauthorized access to or alteration of your data or transmissions
- Any outcome of negotiations, contract discussions, or business decisions informed by our Products
- Any third-party claims arising from your use of our Products
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Transparency Project LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of our Products
- Your violation of these Terms
- Your violation of any third-party rights
- Any communications you send to insurance companies, providers, or other parties using or referencing our data or templates
- Any business decisions you make based on our Products
11. License & Permitted Use
Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable license to use the purchased Product(s) for your own internal, personal, or business purposes. This includes:
- Reviewing and analyzing the data for your own rate negotiations
- Sharing relevant excerpts with your own attorney, accountant, or business advisor in the context of seeking professional advice
- Referencing aggregate data points (e.g., percentile values) in your own rate negotiation communications
12. Prohibited Uses
You may NOT, without prior written consent from Transparency Project LLC:
- Redistribute, resell, sublicense, or share the full report or dataset with any third party
- Publish or post the full report, provider lists, or raw data files on any website, forum, social media platform, or publicly accessible location
- Use the data to build a competing product or service
- Use the data for any purpose that violates applicable federal, state, or local law
- Use the data in any manner intended to harass, defame, or harm any individual provider named in the reports
- Use the data for price-fixing, market allocation, or any conduct that would violate federal or state antitrust laws
- Misrepresent the source, nature, or methodology of the data
- Remove or alter any disclaimers, disclosures, or attribution included in the reports
Violation of these restrictions may result in revocation of your license and may subject you to legal action.
13. Refund Policy
Due to the digital nature of our Products and the immediate access provided upon purchase, all sales are final. We do not offer refunds, exchanges, or credits once a download link has been delivered.
If you experience a technical issue accessing your download (e.g., broken link, corrupted file), contact us and we will resolve the issue promptly.
If you believe you were charged in error or did not authorize a purchase, contact us immediately at the email address below.
14. Privacy Policy
14.1 Information We Collect
When you purchase a Product, your payment and order are processed by Shopify. We receive your name, email address, and transaction details necessary to fulfill your order. We do not directly collect or store credit card numbers or payment credentials.
14.2 How We Use Your Information

- To comply with legal obligations
14.3 What We Do Not Do
- We do not sell, rent, or share your personal information with third parties for marketing purposes

14.4 Third-Party Services
Our website is hosted on Cloudflare. Payments are processed by Shopify. These services have their own privacy policies which govern their handling of your data. We encourage you to review their respective policies.
14.5 Data Retention
We retain order records (name, email, product purchased, date) for accounting and legal compliance purposes. You may request deletion of your personal information by contacting us, subject to our legal retention obligations.

The reports, analysis, visualizations, email templates, written commentary, and overall compilation of data in our Products are original works of authorship protected by copyright law. While the underlying rate data originates from publicly mandated filings, our selection, arrangement, analysis, presentation, and commentary constitute protectable intellectual property.
The Transparency Project name and logo are the property of Transparency Project LLC.
16. Changes to These Terms
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or Products after changes are posted constitutes acceptance of the revised terms.
Material changes affecting existing customers will be communicated via the email address provided at purchase.
17. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these terms or your use of our Products shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the State of Florida in accordance with the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
